The U.S. Senate has scheduled a September vote on the Clarity Act while the SEC considers a tailored crypto offering regime and the CFTC Innovation Advisory Committee meets on August 20, keeping regulatory progress alive for Bitcoin and RWA operators.
Senate Sets September Vote as Regulatory Agencies Press Ahead
The Clarity Act is heading into a defining stretch. The U.S. Senate missed its window to vote on the Digital Asset Market Clarity Act before the August recess, but Senate Majority Leader John Thune filed cloture on the motion to proceed before lawmakers left, keeping the bill alive. A procedural vote is now scheduled for September 15, with the Senate reconvening on September 14.
The bill's path remains narrow. According to Latham's U.S. Crypto Policy Tracker, the legislation must still clear a 60-vote Senate floor threshold, be reconciled with the House-passed version, and receive a presidential signature to become law. The Senate Banking Committee advanced the bill 15-9 in May 2026, but two Democratic supporters signalled that their committee votes did not guarantee floor support. The sticking point remains an ethics provision tied to President Trump's disclosed crypto holdings.
SEC and CFTC Move Forward in Parallel
With Congress in recess, the SEC is not standing still. The agency held an open meeting on August 14 to consider proposing a tailored offering regime for crypto investment contracts, a framework widely referred to as "Regulation Crypto." As reported by Coinpedia, the framework is designed to give qualifying crypto projects a clearer route to raise capital without automatically triggering full SEC registration requirements. TD Cowen analyst Jaret Seiberg described the proposal as the first in a series of expected rulemakings aimed at providing greater market certainty while the legislative process plays out.
On the derivatives side, the Federal Register confirms that the CFTC's Innovation Advisory Committee will hold its inaugural meeting on August 20, from 1:00 p.m. to 4:00 p.m. Eastern Time, to discuss crypto assets, artificial intelligence, and prediction markets. Committee members include senior representatives from Coinbase, Ripple, Robinhood, Kraken, and CME, among others.
Together, these parallel agency tracks matter for institutional $BTC operators and real-world asset (RWA) providers that need federal compliance benchmarks now, regardless of how the Senate vote unfolds in September. Agency rulemaking offers more durable guidance than informal policy statements, even if it operates within the bounds of existing law and can still be subject to revision or legal challenge.
The coming weeks will test whether regulatory momentum at the agency level can hold until Congress acts, or whether the September floor vote delivers the statutory framework the industry has been waiting for.
