Republican and Democratic Senate staff held a flurry of closed-door policy meetings over the past 24 hours in a push to close out remaining disputes on the Digital Asset Market CLARITY Act, per Punchbowl News, racing toward consensus before the chamber breaks for its August recess.

Majority Leader John Thune held off filing cloture on Wednesday afternoon, leaving negotiators only hours to land a deal. If cloture is filed on Thursday, a floor vote could follow as early as this weekend. The decision hands both sides a narrow window: if the Senate leaves Washington without a floor vote, the bill does not die, but its odds worsen considerably, with the next viable window likely falling in 2027, a midterm-shadowed year less friendly to complex legislation.

Two Sticking Points Remain

Ethics language and stablecoin yield are the final obstacles standing between the CLARITY Act and a Senate floor vote.

On ethics, two Democratic swing votes have made their final support conditional on a provision that would prohibit senior government officials, including the president, from having business ties with the crypto sector. A closed-door negotiating session among key senators and White House Crypto Council Executive Director Patrick Witt collapsed without agreement after Republicans and the White House withdrew a provision that would have allowed state attorneys general to sue the Department of Justice.

On stablecoin yield, Republican Senators James Lankford and Mike Rounds are among those seeking changes before backing the bill, while banking groups warn that stablecoin yield provisions could reduce community bank deposits. The current draft bars crypto firms from paying interest or yield on stablecoin balances in a manner economically or functionally equivalent to a bank deposit, but carves out rewards programs tied to bona fide activities or transactions, with Treasury and the CFTC directed to write rules within a year of enactment.

A High-Stakes Deadline

Clearing the Senate requires 60 votes to overcome a filibuster, meaning Republicans need significant Democratic support. Republicans hold 53 Senate seats, meaning roughly seven Democratic votes are needed, and prediction markets had priced 2026 passage in the 30 to 33 percent range before this week's compromise reports became public.

While there is some floor time again in September, lawmakers will be increasingly focused on November's midterm elections, making the first week of August widely considered the last realistic moment for the CLARITY Act to advance from the Senate in the normal course of business.
