Lummis Frames Vote as Jobs and Innovation Issue

Senator Cynthia Lummis (@SenLummis) is stepping up pressure on her Senate colleagues ahead of a critical deadline, arguing that a no vote on the Digital Asset Market Clarity Act is not a political statement against President Trump. It is, she says, a vote to drive American jobs and innovation overseas.

Lummis, who chairs the Senate Banking Subcommittee on Digital Assets, contends that Trump has already delivered the concessions critics demanded through the bill. Opposing it now, she argues, serves only to keep American consumers locked inside a regulatory system that is widely acknowledged to be broken. The single biggest chronic problem in US crypto regulation has been a turf war between the SEC and the CFTC, with both agencies spending years arguing over which digital assets count as securities and which count as commodities. The CLARITY Act addresses that directly by creating a three-category framework, classifying tokens as securities regulated by the SEC, digital commodities regulated by the CFTC, or stablecoins under joint oversight.

Singapore and UAE Named as Ready Alternatives

Lummis specifically named Singapore and the UAE as jurisdictions ready to absorb the industry if the Senate fails to act. Regulatory uncertainty has already sent talent, investment, and innovation overseas, strengthening foreign competitors while leaving American builders without the certainty they need to compete.

The stakes of inaction are significant. Lummis has warned that failing to pass the bill could push comprehensive digital asset legislation into the 2030s. Analyst Brian Gardner of Stifel has written that the bill "probably needs to get through the Senate by the end of July," and that missing the August recess would cause its prospects to "deteriorate materially."

As of late July 2026, the bill has passed the House (294-134 on July 17, 2025) and the Senate Banking Committee (15-9 on May 14, 2026), but has not received a full Senate floor vote. From calendar eligibility, the bill still requires a cloture motion, a successful 60-vote invocation, formal reconciliation with the Senate Agriculture Committee's companion measure, and a presidential signature. The Senate's state work period begins August 10, 2026, and while a vote could technically happen in the fall, appropriations fights and the election calendar make floor time scarce, leading most observers to treat early August as the practical cutoff.
