Lummis accuses Democrats of tanking the CLARITY Act to protect midterm messaging

A Political Fight Dressed as a Policy Dispute

Senator Cynthia Lummis (@SenLummis) is accusing Senate Democrats of deliberately blocking the Digital Asset Market Clarity Act, not over policy concerns, but to protect their midterm election messaging around President Trump and crypto. The charge came in response to a Bloomberg Government report noting that some Democrats fear a negotiated deal could blunt a potent political attack line centered on Trump's personal crypto holdings.

In a post on X on July 31, the Wyoming Republican said the bill includes a provision requiring public officials, including Trump, to sell their digital assets or place them in a blind trust, and criticized some Democratic lawmakers for focusing on political attacks tied to the midterm elections rather than passing the legislation to protect investors.

Democrats push back on that framing. Their core objection is that the ethics provision as written has significant gaps: assets issued before taking office are largely grandfathered, the rules sunset in 2029, and family members beyond spouses are not covered. Senators Chris Murphy, Chris Van Hollen, and Jeff Merkley formally opposed the bill in mid-July after a merged draft dropped an ethics provision Democrats had made a condition of their support. Murphy has called this the moment to force full divestment, arguing the current language does not go nearly far enough.

Clock Running Out Before August Recess

Republicans released an updated version of the CLARITY Act that includes ethics provisions for federal officials and bans on crypto being used for illicit transactions, but Democrats say the Justice Department should not be the regulator to enforce a ban on elected officials issuing crypto, with senators who supported an earlier version vowing to oppose the new one.

Lummis said Senate Majority Leader Thune has kept a place for the CLARITY Act on the agenda before the August recess, and that she believes he intends to follow through. Still, the arithmetic is difficult. Republicans hold 53 seats and passing cloture requires 60 votes, meaning roughly 7 to 10 Democrats need to sign on.

Prediction market Polymarket priced the probability of 2026 passage at 28% on July 30, down from a peak of 82% in February. If the Senate breaks for recess without a floor vote, failure in 2026 would not kill the bill, but it would push final passage into 2027, an election-shadowed year. For an industry that has waited years for a federal regulatory framework, that delay carries real consequences.
