Sen. Lummis Warns CLARITY Act Delay Could Push Vote To 2030

Senator Cynthia Lummis (@SenLummis) has issued a stark warning: if the Senate fails to pass the CLARITY Act this year, comprehensive crypto market structure legislation could be pushed back to 2030, costing the United States years of potential jobs, investment, and tax revenue.
A Bill Still Waiting for a Senate Vote
The Digital Asset Market Clarity Act of 2025, more commonly known as the CLARITY Act, is proposed US legislation intended to create a clearer federal framework for digital assets. The House passed the bill in July 2025, and a revised version cleared the Senate Banking Committee in May 2026. Despite that progress, no official vote date has been set for the full Senate floor.
The CLARITY Act's status as of late July 2026 is that it has passed the House but has not received a full Senate vote, and the window for 2026 passage is closing. Majority Leader Thune publicly cast doubt on passage before the August recess, and Senate leadership subsequently prioritized federal appointments and a Russia sanctions package, shelving the CLARITY Act ahead of the recess. Her comments come as lawmakers prepare for a planned September 15 procedural vote on the legislation.
Customer Protection at the Core of Lummis's Argument
Lummis has framed the bill not just as a market structure measure, but as a consumer safeguard. The CLARITY Act would legally recognize customer ownership of deposited crypto, preventing assets from being swept into an exchange's bankruptcy estate as occurred with Celsius, Voyager, and FTX, which left millions of customers exposed to billions of dollars in losses.
The bill would require clear segregation of customer assets and likely impose stricter custodial, auditing, and compliance standards for centralized exchanges, providing legal clarity that could boost crypto adoption and restore confidence. Lummis has argued that stronger custody and asset-segregation requirements could have prevented the FTX failure.
Beyond customer protection, Lummis has also emphasized the bill's economic stakes. Without a clear federal framework, she argues, the regulatory uncertainty that has long defined the US crypto landscape will persist, pushing innovation and capital offshore. The lack of a unified regulatory framework has resulted in what many stakeholders describe as "regulation by enforcement," creating legal uncertainty, constraining traditional financial institutions, and pushing innovation abroad.
With Democratic opposition hardening over ethics provisions and Senate floor time scarce, the bill's path remains uncertain. But for Lummis, the cost of inaction is clear: more years of unprotected customers, lost investment, and a regulatory vacuum that rivals are already filling.
