The CLARITY Act missed its summer deadline because the Senate adjourned for its August recess without voting on the bill, leaving unresolved disputes over ethics rules, stablecoin rewards, and anti-money-laundering language. 

Senate Majority Leader John Thune has since filed cloture on the motion to proceed, setting up a procedural vote for September 15, 2026, the first floor action the bill has seen since clearing committee.

What Happened To The Summer Deadline?

The bill, formally known as the Digital Asset Market Clarity Act or H.R. 3633, had strong momentum heading into August. It passed the House 294 to 134 in July 2025, and the Senate Banking Committee advanced it 15 to 9 in May 2026. But when the Senate left Washington on August 8 for recess, it did so without a floor vote, pushing the timeline into September.

Several issues remain unresolved going into the vote:

  • Ethics restrictions tied to President Trump and his family's crypto holdings
  • Stablecoin reward provisions, which community banks argue could pull deposits out of the traditional banking system
  • Anti-money-laundering language that both parties still dispute
  • How DeFi platforms and regulatory authority get divided between the SEC and CFTC

Senator Thom Tillis has warned the bill "is going to fail" without White House help bridging the ethics divide, according to reporting from Semafor. Coinbase policy chief Faryar Shirzad has laid out two possible outcomes: the bill falls just short of 60 votes, or enough Democrats cross over to build momentum for undecided senators to follow.

What Happens If Cloture Fails?

If the motion fails on September 15, most Washington observers consider the bill effectively dead for 2026. Senator Cynthia Lummis has said the next realistic opportunity would not come until 2030 under a new Congress, since midterm politics make comprehensive crypto legislation unlikely between elections.

Even if cloture succeeds, the path is narrow. The House has canceled votes for the final two weeks of September, leaving only about one week before lawmakers focus on the November midterms. The Senate would still need to debate amendments, hold a final passage vote, and reconcile its text with the House version before anything reaches the president's desk.

Prediction-market odds for 2026 passage have been volatile, with contracts on platforms including Polymarket and XO Market pricing the chances in the high-teens to low-twenties percentage range through late August. 

Bitcoin traded near $77,200 on September 11, 2026, down about 1.6% over 24 hours, as the market watches the vote alongside inflation data and Federal Reserve signals.
