US Treasury Secretary Scott Bessent (@SecScottBessent) has renewed pressure on the Senate to advance the CLARITY Act, framing the stalled cryptocurrency legislation as a matter of national security rather than market regulation alone.

A National Security Argument

In a post on X, Bessent called on senators to keep negotiations alive when Congress returned from its August recess. He warned that failure to act would "send a troubling signal to our allies and adversaries alike that America is unwilling to lead on the future of digital assets and willing to forgo enhanced national security tools to combat their misuse."

Bessent has framed the legislation as a national security matter, arguing the US should author global digital asset rules instead of importing them. His argument goes beyond standard market oversight, focusing specifically on the government's ability to stop bad actors from exploiting the technology. He described the bill as an effort to create clear rules for digital assets while strengthening the government's ability to prevent their misuse.

Bessent urged everyone to "remain at the negotiating table, agree to the motion to proceed, and continue the legislative process" rather than let the bill collapse.

Where the Bill Stands

The Digital Asset Market Clarity Act was passed by the House in July 2025 with a 294 to 134 bipartisan majority and has been working through the Senate in 2026. The legislation would split regulatory oversight of digital assets between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC), and shield blockchain developers from liability for how third parties use their code.

A merged 600-plus-page Senate text landed in late July 2026 carrying a first-of-its-kind ethics provision, but three fights remain unresolved: who enforces the ethics rules, whether stablecoin rewards survive, and how far developer protections extend. With odds at record lows, September is now the realistic window.

In June, the Blockchain Association sent a letter cosigned by 160 former national security and law enforcement officials to Senate majority and minority leaders expressing strong support for the CLARITY Act. The broad coalition signals that Bessent's security framing has resonance beyond the Treasury.

The path forward remains narrow. The legislation still faces disagreements over crypto holdings, stablecoin rewards, and measures targeting illicit finance. For Bessent, letting those disagreements derail the bill entirely would carry a cost that goes well beyond regulatory inconvenience.
