CLARITY Act Faces a Serious Delay Threat
A shortened House September schedule has raised fears that the CLARITY Act, the landmark US crypto market structure bill, could be pushed into the post-election lame duck period, complicating its path to passage in 2026.
House Calendar Crunch Rattles Crypto
The Digital Asset Market Clarity Act is facing a fresh legislative obstacle after House Republican leaders canceled the final two weeks of September, leaving the crypto industry's most important bill in Washington with a dangerously narrow window to advance before the midterm elections.
Punchbowl News senior reporter @BrendanPedersen was direct in his assessment, calling the scheduling change potentially "very bad news for the crypto industry." He noted that while the Senate is set to hold an initial procedural vote on the CLARITY Act on September 15, the House is now expected to leave Washington as early as September 17, leaving almost no time for the lower chamber to respond if the Senate passes an amended version of the bill.
House Majority Whip Tom Emmer's office informed Republican members that the weeks of September 21 and September 28 had been removed from the voting calendar, cutting eight previously scheduled legislative days. Under the revised timetable, representatives return after Labor Day for just four voting days before departing Washington on September 17.
Lame Duck Looms as the Likeliest Path
The timing problem runs deeper than a simple scheduling conflict. Punchbowl News reported that the House cancellations make it "a near-certainty" that the CLARITY Act has become a fight for the lame duck session, the post-election period when the makeup of Congress may already be shifting. A total of 78 Democrats voted for the House version of the legislation in 2025, but lame duck politics could reduce that number if control of either chamber flips in November.
The procedural complexity compounds the calendar risk. The Senate's September 15 vote would only open floor debate, not finalize the bill. Any Senate amendments would require the House to vote again on the revised text, or both chambers would need to agree on a common version before sending it to President Trump. Alex Thorn, head of firmwide research at Galaxy Digital, said the shortened September session makes it "extremely unlikely" that CLARITY will pass before the midterm elections.
The CLARITY Act (H.R. 3633) passed the House 294 to 134 in July 2025 and cleared the Senate Banking Committee 15 to 9 in May 2026. The legislation would divide oversight of the US digital asset market between the SEC and the CFTC while establishing registration rules for crypto trading platforms.
