America's landmark crypto market-structure bill is facing its most serious test yet. With a key Senate procedural vote just days away, a former federal prosecutor has declared the CLARITY Act effectively dead, and the clock is running out for Congress to act.
Insider Warnings and White House Pushback
Renato Mariotti, a former federal prosecutor, spent last week meeting with members of Congress and their staff in Washington. After those conversations, the consistent message he received was blunt: the bill is finished, and "Congress is entering a post-CLARITY era." Mariotti posted his assessment publicly, adding weight to what has become a growing chorus of doubt inside the Capitol.
The reaction from the White House was pointed. Patrick Witt, a crypto advisor to the administration, responded to the criticism by writing "collecting receipts," a signal that he is keeping track of who is working against the bill's passage.
Mariotti has not pointed to an official vote count or public document to back the claim, and lawmakers have not confirmed it on the record, so it remains an informed observer's read on the mood in the Capitol rather than a confirmed outcome. Still, the comments have added to a broader sense of unease around the legislation. Bitwise CIO Matt Hougan called the bill "walking dead," saying, "Nothing can actually kill it, but it will lurch along."
A Shrinking Window
The CLARITY Act is scheduled for a Senate cloture vote on the motion to proceed on September 15. That date marks a procedural gatekeeping test that determines whether the chamber can begin formal debate on a comprehensive crypto market-structure framework, and it needs to clear the 60-vote threshold. Republicans control 53 Senate seats, so at least seven Democrats would need to join a unified GOP conference to hit that mark.
Prediction market platform Polymarket prices CLARITY passage in 2026 at 13 to 18%, down from 82% in February. Senator Cynthia Lummis, one of the bill's strongest advocates, has warned that a failure this month would push market-structure legislation back to 2030.
Even if the Senate clears the cloture hurdle, the House calendar creates an additional obstacle. The bill is running out of time in the House, which canceled two full weeks of scheduled September sessions, leaving lawmakers with only 14 active working days before the October election recess. That leaves very little time for the House to debate, reconcile, and vote on a final version if the Senate manages to advance the legislation.
The CLARITY Act would create a regulatory framework for cryptocurrencies and other digital assets, much like the GENIUS Act did for payment stablecoins in 2025. Its fate over the next week will define the trajectory of US digital asset regulation for years to come.
