Lummis Seeks Approval of Clarity Act Before September 15 Vote

Senator Cynthia Lummis (@SenLummis) is pressing the U.S. Senate to advance the Digital Asset Market Clarity Act ahead of a procedural vote on September 15, 2026, calling it a defining moment for American leadership in digital finance. Lummis has warned that failure to pass the legislation means the industry "will not get another realistic shot at this before the end of the decade."

Senate Majority Leader John Thune filed a cloture motion on the motion to proceed before the August recess, setting up the September 15 vote on whether to limit debate and advance the measure to the full Senate floor. The cloture vote requires 60 Senate votes, and Republicans currently hold only 53 seats, meaning supporters would need additional Democratic or independent backing.

What the Clarity Act Would Do

The Digital Asset Market Clarity Act, or H.R. 3633, is proposed federal legislation that creates a regulatory framework for digital assets by splitting oversight between the SEC and the CFTC. The SEC would keep authority over securities and investment contracts, while the CFTC would gain exclusive jurisdiction over digital commodity spot markets. Supporters argue the division would replace years of regulatory ambiguity with a clear statutory rulebook.

Lummis has made similar arguments since FTX's collapse in 2022, pointing to Wyoming rules that restrict banks and exchanges from relending customer digital assets and arguing that stronger custody and asset-segregation requirements could have prevented the failure. The bill's custody provisions reflect that experience directly.

The Senate delayed a floor vote ahead of the August recess due to partisan disagreements over ethics rules and banking opposition. Seven Democratic senators issued a joint statement calling the current draft insufficient on ethics, consumer protection, and illicit finance, making their support conditional on text changes that have not materialized.

A Closing Window

When lawmakers reconvene on September 14, the calendar offers only 14 working days before an October election recess, and with the full House and about one-third of Senate seats on the ballot in November, election-season pressures are expected to consume lawmakers' attention.

The September 15 vote is on cloture on the motion to proceed, not final passage. Clearing it opens the bill for debate and amendments, while failing it ends Senate consideration under the current motion. If the bill fails, the crypto industry faces regulation by enforcement until at least 2029, along with a fragmented patchwork of agency rulemaking from the SEC, CFTC, OCC, and FASB.

SEC Chair Paul Atkins said he expects the Senate to advance the legislation and that the agency's proposed crypto rules are designed to align with it. The bill cleared the Senate Banking Committee in May on a 15-9 vote, the first time a broad digital asset regulatory framework had passed a congressional committee, while the House passed it 294-134 in July 2025.
