White House crypto adviser Patrick Witt says he feels confident heading into Tuesday's Senate procedural vote on the Digital Asset Market Clarity Act, describing the current proposal as the administration's last word on the matter.

White House Calls Latest Draft Its 'Best and Final Offer'

Speaking at a Solana Policy Institute summit in Washington on Monday, Witt said the White House has attempted to address all issues raised throughout CLARITY Act negotiations, calling the latest version the "best and final offer." He also indicated that Republicans had accepted 95% of the Democratic negotiating team's demands on the CLARITY Act, and that any remaining Senate opposition must, at this stage, be political.

In a separate interview with Semafor on September 10, Witt said he remains optimistic about the Senate's September 15 procedural vote, adding that Republican support could be close to all 53 senators. The bill's bipartisan character remains central to the White House's pitch. Cloture requires 60 votes, or 60% of the chamber. Republicans hold 53 Senate seats, meaning at least seven Democrats or independents would need to join if the Republican conference stays unified.

A Long Road to Tuesday's Vote

The 600-page CLARITY Act is designed to hand the United States a federal framework for digital asset markets and has faced repeated setbacks on its path through the Senate. The measure cleared the House in July 2025 by a 294-134 vote and advanced from the Senate Banking Committee in May by a 15-9 margin.

Senate Majority Leader John Thune scheduled a cloture vote for September 15, a procedural step that would limit debate and move the bill toward a full vote. Ethics rules, stablecoin rewards, and money laundering safeguards remain unresolved ahead of the vote. Some Democratic lawmakers may still be holding back after the latest draft, according to their staffs.

President Donald Trump has also shown a willingness to make further compromises on government ethics provisions. Witt said Trump "blessed" the latest ethics language, noting he met with the president on Friday to walk him through the provisions, and that Trump agreed to further concessions after being assured the section could not be used against him.

With the Senate's calendar thinning ahead of the midterm election recess in early October, if the cloture vote fails, the Clarity Act could effectively be dead for this congressional session. Passing it would allow the bill to move deeper into formal debate and toward final passage, keeping alive the prospect of comprehensive crypto market structure legislation becoming law in 2026.
