Senate Blocks Landmark Crypto Bill

Strategy founder Michael Saylor (@saylor) is framing the Senate's failure to advance the Digital Asset Market Clarity Act as a potential positive for the digital asset industry, bucking the broader industry view that the vote was a major setback.

The Senate held a procedural cloture vote on September 15, 2026, which failed 49 to 50 against a 60-vote threshold. The bill needed 60 votes to clear the cloture step, but the motion failed, leaving the legislation stalled at that stage. The Digital Asset Market Clarity Act was designed to establish a federal regulatory framework for digital assets and draw clearer boundaries between the SEC and the CFTC. The core dispute centred on ethics language around officials' crypto holdings, rather than the broader market-structure framework itself.

The House had passed the CLARITY Act in July 2025 by a 294-134 vote, but disagreements in the Senate over ethics, rewards, DeFi, and regulatory authority prevented the bill's quick passage.

Saylor's Case for Moving On

Saylor argued that the digital assets industry was "better off" pursuing supportive rules from federal regulators than accepting the restrictions written into the final CLARITY Act compromise. He called the bill's rejection a "positive inflection point" and warned that laws could make restrictions permanent.

Saylor acknowledged the strongest argument for CLARITY, that a law could protect the industry from a future hostile administration, but countered that "no statute removes politics from regulation." He argues that legislation can entrench restrictions just as easily as it creates new rights, and that the industry is better served by scaling compliant products while the regulatory window remains open.

Despite the vote, regulators like the SEC and CFTC are pushing ahead with rulemaking. "We have an administration willing to modernize financial markets. We should use the next two years to put better financial products into people's hands," Saylor wrote.

On September 17, the SEC issued a five-year Innovation Exemption for onchain trading of tokenized stocks, and the CFTC issued a no-action position for software developers, with the SEC's Regulation Crypto Assets proposal open for public comment until October 20, 2026. SEC Chairman Paul Atkins said the agency would continue using its existing authority after Congress failed to advance the bill.

With 2026 nearing Q4, Saylor wants the industry to refocus on 2027 and 2028, using existing regulatory openings to scale products before pursuing narrower legislation where additional congressional authority is actually required.
