CLARITY Act Takes a Hit, But Democrats Aren't Done

The push for comprehensive U.S. cryptocurrency regulation suffered a fresh blow this week, but a bloc of seven Democratic senators insists the effort is far from finished.

Senate Rejects Procedural Vote

The Senate on Tuesday voted 49-50 to block the Digital Asset Market Clarity Act from advancing, falling well short of the 60 votes needed to clear a filibuster. The failed cloture vote was a significant blow to the bill, which had been billed as the most consequential piece of crypto legislation ever to reach the Senate floor. The procedural vote leaves the bill stalled on Capitol Hill after months of negotiations aimed at building bipartisan support.

The bill would create a new federal regulatory framework for the $2.3 trillion crypto industry, but has faced growing opposition from Democrats due to President Donald Trump's investments in the sector. Republican leaders had released a revised version of the bill on Sunday, adding new ethics restrictions to address Democratic concerns about public officials profiting from crypto ventures, but the changes proved insufficient. Leading up to the vote, Democrats expressed frustration that Republican negotiators did not meet their demands regarding ethics to address profits gained from crypto ventures by President Donald Trump and his family.

Seven Democrats Signal They Will Press On

One day after the vote, Senators Kirsten Gillibrand (D-NY), Angela Alsobrooks (D-MD), Cory Booker (D-NJ), Catherine Cortez Masto (D-NV), Ruben Gallego (D-AZ), Mark Warner (D-VA), and Raphael Warnock (D-GA) issued a joint statement on the CLARITY Act. The group said the failed vote was not a final verdict on their efforts. "This week was a setback, but not the end of that important work. We remain committed to working in a bipartisan fashion to get this legislation passed," the senators said.

The seven senators have been the core Democratic bloc negotiating the CLARITY Act since the bill began moving through committee. Alsobrooks and Gallego were the only two Democrats to vote the legislation out of the Senate Banking Committee in May. Gillibrand has been the Democratic co-architect of market structure talks for years.

Analysts are less optimistic. Industry analysts say it is highly unlikely for the bill to pass this Congress, and instead pointed to the SEC and CFTC's rulemaking efforts. Whether the CLARITY Act is dead or merely paused depends on whose framing holds. Republicans control the floor calendar and have not scheduled another vote. The seven Democrats have offered no new text and no timeline, only a repeat of language they have used before, leaving the bill's fate uncertain heading into the midterm election season.
