Senate CLARITY Act Vote Fails 49-50, Sending $BTC and Crypto Markets Lower
The U.S. Senate failed to invoke cloture on the CLARITY Act 49 to 50, falling 11 votes short of the 60 needed to open floor debate. Bitcoin dipped below $75,000 on the news before recovering slightly.
The U.S. Senate dealt a significant blow to crypto market-structure legislation on Monday, voting 49 to 50 against invoking cloture on the Digital Asset Market Clarity Act, commonly known as the CLARITY Act. Backers of H.R. 3633 needed 60 votes to open formal floor debate and fell 11 short, failing even to clear a simple majority.
What the Vote Means
The procedural cloture vote required 60 senators to agree to advance the bill to full floor debate. Failure at this stage effectively ends the bill for 2026, and likely until 2029 given the midterm election calendar. With Congress poised to be under split party control next year, it is unclear when the legislature may return to market-structure legislation.
The bill sought to establish a federal market-structure framework for digital assets and clarify how the Securities and Exchange Commission and the Commodity Futures Trading Commission divide oversight. It had passed the House 294 to 134 in July 2025 and cleared the Senate Banking Committee 15 to 9 in May 2026. Democrats wanted the bill to include robust ethics, conflict-of-interest, and illicit-finance safeguards, while Republicans pushed for clarity and certainty for markets and innovation. Those differences ultimately proved too wide to bridge before the vote.
Market Reaction
Crypto markets moved swiftly on the result. $BTC dipped to just under $75,000 after the outcome was confirmed before recovering to around $76,000, leaving it down roughly 3.79% on the day. $XRP fell harder, shedding approximately 9.74%, while the total crypto market cap sat near $2.59 trillion, off around 3.63%.
Implied odds on decentralized prediction platform Polymarket for the CLARITY Act being signed into law in 2026 had already plummeted to just 18%, falling sharply from a peak of around 30% the previous day. The failed vote will likely push those odds close to zero for the current legislative session.
For the crypto industry, the outcome means the regulatory status quo continues. A failed cloture vote does not repeal the House-passed bill, but it stalls formal Senate consideration and keeps the dual SEC-CFTC compliance track that firms have built by default.
