The CLARITY Act is Hitting Serious Trouble Before its Senate Return
Republican senators are warning the CLARITY Act could fail its September 15 Senate cloture vote, with ethics language tied to Trump and his family emerging as the central sticking point.
The Digital Asset Market Clarity Act (CLARITY Act), the most ambitious attempt yet to establish a federal regulatory framework for crypto markets, is entering a critical week under significant strain. Republican senators have gone on record with downbeat assessments of the bill's chances ahead of a scheduled Senate floor vote on September 15.
Republicans Sound the Alarm
Sen. Mike Rounds said the bill's prospects "do not look good right now." Sen. Thom Tillis was more direct, warning that the bill is likely doomed unless the White House shows willingness to negotiate on ethics restrictions, telling Semafor: "If there's no interest in the White House in trying to bridge the gap on the ethics language, it is going to fail."
The ethics dispute centers on language tied to President Donald Trump and his family's crypto businesses, a politically charged sticking point that has made some Democrats reluctant to hand the bill their votes even after supporting it in committee. The proposed amendments would bar the president, vice president, members of Congress, and other top officials from profiting from crypto businesses while in office, with Trump's meme coins and his family company, World Liberty Financial, at the center of the debate.
The disagreement has continued despite several attempts by bipartisan negotiators to produce compromise language, including negotiations between Tillis and Sen. Ruben Gallego (D-Ariz.). A compromise was previously sent to the White House, but its status has remained unclear.
A Tight Calendar and a High Bar
The Senate will hold a procedural vote on the CLARITY Act at 2:15 p.m. ET on September 15. Republicans need at least seven Democratic or independent votes to reach the 60-vote threshold. Adding to the pressure, House Republican leadership has cancelled planned voting weeks of September 21 and 28, meaning the chances of CLARITY reaching President Trump's desk before the midterms have become extremely slim.
Not everyone is ready to write off the bill. Paradigm's Alexander Grieve has said the legislation is "not dead, not by a longshot," reflecting a view in parts of the crypto industry that pessimistic statements from lawmakers may be a negotiating tactic rather than a final verdict.
The House passed the CLARITY Act in July 2025 by a 294-134 vote, but disagreements in the Senate over ethics, rewards, DeFi, and regulatory authority have prevented quick passage. Galaxy Research has cut its odds that the CLARITY Act will become law in 2026 from 50% to 30%. With the Senate returning September 14 and midterm campaigns pulling attention away from Washington shortly after, the window for a deal is narrow.
