Tom Lee Sees CLARITY Act Opening Crypto Floodgates

Fundstrat Managing Partner and Bitmine Immersion Technologies chairman Tom Lee (@fundstrat) says the passage of the Digital Asset Market CLARITY Act could be the single biggest catalyst for institutional capital entering the crypto market.

Speaking on Global Money Talk, Lee said the bill could "open up the floodgates" for institutional adoption on a scale the industry has not seen before. His comments come as the legislation continues to work its way through the US Senate following House approval.

A Unified Framework to Replace Regulatory Fragmentation

At the heart of Lee's argument is the current state of US crypto oversight. Today, exchanges and asset managers must navigate a patchwork of state money-transmission licences, competing federal agency claims between the SEC and the CFTC, and shifting judicial interpretations. Lee says the CLARITY Act would replace that fragmentation with a single federal regulatory structure, giving institutional players the legal certainty they need to commit capital at scale.

The bill itself, formally known as H.R. 3633, would assign clear SEC and CFTC jurisdiction over different classes of digital assets and introduce unified consumer safeguards. The Senate Banking Committee advanced the legislation by a vote of 15 to 9 in May 2026, though the full Senate vote remains outstanding.

Lee also pointed to the competitive pressure facing the US. He argued that Japan and other major economies have already adopted clearer crypto frameworks, and that without comparable federal legislation, capital and talent will continue migrating to jurisdictions with more predictable rules.

Ethereum Strength as an Adoption Signal

Alongside the regulatory argument, Lee highlighted $ETH's recent market performance as a sign that investors are already positioning for the next phase of adoption. He noted that Ethereum has outperformed memory stocks by more than 70 percentage points since late June, a divergence he described as a structural shift rather than a short-term trade.

Lee's broader thesis frames $ETH as downstream infrastructure for tokenized real-world assets and institutional decentralised finance, with the CLARITY Act serving as the policy trigger that could accelerate that buildout. He also described prediction markets as underpricing the bill's chances of passing, suggesting the market has not fully priced in the potential upside.

Whether or not the legislation clears the Senate before the August recess, Lee's view is that the direction of US crypto policy has shifted decisively, and that institutional adoption is a matter of when, not if.
