Senate Fails to Clear Procedural Hurdle on Landmark Crypto Bill

The US Senate dealt a significant blow to the American crypto industry on September 15, 2026, after the Digital Asset Market Clarity Act, widely known as the CLARITY Act, failed to clear a key procedural cloture vote. The Senate did not advance the bill after over 40 Senators voted against it. The bill needed at least 60 yes votes to clear the hurdle, meaning all 53 Republicans would have had to back it, along with seven Democrats or Independents.

The CLARITY Act was designed to define how federal regulators, the Securities and Exchange Commission and the Commodity Futures Trading Commission, can oversee crypto markets. The House passed the bill in July 2025, and a revised version cleared the Senate Banking Committee in May 2026. Its chances of clearing the Senate faded after Republicans rejected a counteroffer from Democrats, leaving the two sides far apart.

Senators split along party lines. @SenLummis accused Democrats of moving the goalposts, while @Sen_Alsobrooks said the bill is not dead. The bill's failure likely spells the end for any crypto market structure legislation in 2026, and with Congress poised to be under split party control next year, it is unclear when the legislature may return to market structure legislation.

Industry and White House Warn of Competitive Risk

Reactions from the crypto industry and Washington were swift and pointed. @chainlink called the vote a setback, warning that capital, builders, and market share leave the country each month without a regulatory framework in place. @Securitize said it was disappointed but noted that tokenized securities already sit inside existing federal securities rules, and said it expects the SEC and CFTC to press ahead with rulemaking regardless.

White House crypto adviser @patrickjwitt warned that the risk now is that global financial standards get set in Brussels or Beijing rather than Washington and New York. Aave founder @StaniKulechov said DeFi has to win through adoption instead, while Solana co-founder @toly noted the US remains one of the last G20 economies without a dedicated crypto bill.
